Every citizen of the European Union has the right to their own privacy and to the protection and confidentiality of their personal data and information. However, there are occasions in which a private individual must interface with companies and entities that request to gain possession of a certain category of information about him. In the real estate world for example, agencies must become aware of an important volume of information not only on their clients, but also on the properties and assets they own. Once all the data has been collected, the agencies carry out checks and also – in the advanced stages of the sale – provide details to third parties, such as notary offices.
The fact that the customer consents to the collection and subsequent transfer of their data may be obvious, but it is advisable for the agency to fully inform the customer regarding the purposes and methods the data collected will be processed for. In fact, the citizen has the right to decide how personal data is used, also becoming aware of any third parties to whom these may be transferred. As a further element of control, the citizen has the full right to interrupt consent to the processing of their data. At any point, he can revoke his consent.
To protect this type of information exchange, Regulation (EU) 2016/679 (GDPR) requires any personal data collected to be processed transparently and lawfully. This is valid since 2018 in all of the 27 countries.
Collected data also must be used only for necessary and declared purposes, and must be kept only for as long as needed. There is also an obligation to keep the data securely and confidentially. To ensure that data is collected lawfully, citizens should receive and retain the information on the processing of personal data. Following the delivery of the information, the citizen can sign a form with which he freely, unequivocally and expressly gives his consent in written form for the purposes requested.
Being able to demonstrate with an appropriate form that we have the informed consent of a citizen for the processing of their personal data is not only important for protection reasons, but is a fundamental requirement to be able to act in compliance with anti-money laundering legislation. In fact, it is necessary for the customer to have given consent to the processing of their data in order to include the details in the appropriate verification forms.
